CLIENT TERMS

NATURE OF THE REALTIONSHIP

Facilitation, mentoring, strategic advise and coaching is a relationship that’s collaborative and partnering in nature. Christine McDougall will always honour your sovereign choice. She will tell you the truth as she see’s it. She will offer all of her skills, knowledge, experience, and wisdom in service to you and your business and life.

Throughout our formal relationship, the client can count on Christine to be clear, compassionate, honest, and skilful towards the client’s evolution by asking clarifying questions, offering feedback and reflection, and holding space for the client’s own wisdom to unfold.

The client understands that the power of the relationship lies in the client’s willingness and capacity to be honest, open and clear, to take responsibility for his or her own choices and decisions and to ask for what he/she needs to support their best. This is a partnership, and both Christine and the client agree to participate in it fully, so it may serve the client fully.

You understand that you are responsible for your own level of participation within the mentoring/coaching/facilitation/advising context, and the results that follow. You acknowledge that you assume all risks related to your use, non-use or misuse of the services and suggested actions. At all times the choice to enact is yours alone.

PERFORMANCE OF SERVICES

Your sessions will be scheduled in advance once your completed agreement and payment has been received.

Your agreement covers the number of sessions included in your program with Christine McDougall as well as your start and end dates.

All sessions will be completed within the designated months of the signed agreement.

Reschedules/Cancellations/Missed Appointments

If you must cancel an appointment, please let us know at least 96 hours (4 days) in advance. This time is being held for you — missed appointments and late cancellations will not be rescheduled or refunded.

Intellectual Property

All intellectual property shared with you during this relationship is available for your use as an individual with attribution. If the contract is under a company name, then the company may not share, copy, re-publish, edit or sell any of the content for business or commercial use, without prior consent.

Payment

Excludes GST for Australian citizens. For Canadian, Australian and US citizens the quote is in your currency. For UK and Euro the quote is $US. Payment plans are available once your application is approved and by pre-agreement. No refunds are available after the initial session. All fee’s are payable in advance.

Late payments. If for any reason your payment is delayed or late, an administrative fee of $65.00 will be added to your next payment.

Rates or Expenses:

All rates are exclusive of GST for Australian residents.

All expenses will be charged at cost and by agreement before incurred.

Booked, non-cancellable or changeable travel, accommodation and/or other expenses will be billed at cost.

Air travel which exceeds five hours duration will be booked as Business Class. Fully Flexible fares will be booked.

Interstate travel will incur a daily charge of $300 as a contribution to travel time.

Christine McDougall will invoice the Client any out-of-pocket expenses including those listed in the agreement and any other costs and general expenses relating to the assignment as they are incurred or on completion of the offsite.

Termination

By signing an agreement you are committing to the full term of the agreement.

The purchase of a mentoring/coaching/facilitation program or retreat is non-refundable. If you’re unsure whether this is the right program for you, please familiarise yourself with Christine’s work before you make the investment.

You will automatically be subscribed to Sunday Syntropy, Christine’s weekly newsletter. You can unsubscribe from this at any time. In addition, you will be notified of special offers, speaking engagements and other relevant information.

Confidentiality

The Client recognises that Christine McDougall will have confidential and proprietary information (collectively, “Information”) which comprises valuable and unique assets of Client. All such assets are completely confidential and will be protected from improper disclosure.

In consideration for the disclosure of the Information by the Client, Christine McDougall agrees that the company’s principal, Christine McDougall, will not at any time or in any manner, either directly or indirectly, use any Information for her own benefit, or divulge, disclose, or communicate in any manner any Information to any third party without the prior written consent of Client, unless required to do so by law.

Christine McDougall will protect the Information and treat it as strictly confidential. A violation of this paragraph shall be a material violation of this Agreement. The confidentiality provisions of this Agreement shall remain in full force and effect after the termination of this Agreement.

Applicable Law

This Agreement shall be governed by the laws of the State of Queensland.

Independent Contractor

The parties agree that:

(a) Christine McDougall is an independent contractor;

(b) no employment relationship is created by this Agreement;
